Yes I appreciate that but essentially its like a TV box from Virgin (don't suppose that's an option for you now) which they own and have a responsibility to give you the products you require - that forms part of your contract. Sky is different because at some point the box becomes the property of the customer. Other suppliers are available!!
For broadband the router is the property of the supplier initially, but chargeable if you leave your contract early, and after your initial contract is up it becomes yours.
So why can't customers sue if smart meters don't deliver what they've promised?

my average gas/electric usage between midnight and 6am has always bee between 60p and at max 98p which included standing charges and electric/gas i used between toughs hours.
Sat here thinking about this and looking back through my account. This happened before when the clocks went forward and now again when clocks went back.
I am just looking at this as a possible programming problem?
Indeed the DCC do operate on UTC (not BST) according to Ofgem section 14

Technically, if they (smart meters) are contractually involved in a process or service (such as reading your meter for you, or helping you to save energy/money) for which you, the customer pay a subscription (your standing charges?) then they ought to be subject to consumer rights laws, but I'll lay money that the energy industry have some very cute legal folks who have found the loopholes and have written those into the system somewhere.
Rollout of smart metering is actually an 'EU thing'. Now we're out of the EU....

I've just realised why they don't charge for installing a smart meter - its because charging would give you rights under consumer law to get the things fixed when they go wrong!
I wonder though, if its been made a contract condition of you tariff to have one, whether that would give a customer the right to sue for damages when the promises are not lived up to.
I have no doubt that buried in the T&Cs are more exclusions that you can wave a stick at.
Also, as long as energy passes through to the customer and it's charged correctly, wouldn't they argue that the smart meter is doing what it's been designed for in terms of the customer?

My 'dumb meter' can do that perfectly well. I just object to paying a proportion of my Standing Charge in perpetuity for all the supposedly smart ones...
