Allegedly, the 'industry' aren't allowed to. In reality, it happens all the time. A neighbour at the other end of the village had her meter replaced yesterday as I'd done some electrical work for her a few months back and pointed out her meter was thirty years out of date and her meter tails were seriously sub-par.
The engineer happily fitted an EDMI ES-10B without a comms hub. He clearly knew there's no point in fitting them round here as we have no connectivity.

@Kentos - yes, everything's fine. The real issue for me, using Eon as an example at least, is that they appear to have no ability to remotely configure the meters. My second meter was clearly working fine (as is yours) but the off peak timings need adjusting. This is a standard reconfiguration that should be able to be done over the air and remote configuration is a fundamental piece of the smart meter business case. I asked specifically for the meter to be reconfigured over the air (using info provided from Octopus tech support as an example) and after escalation I was told that it couldn't be done and the meter needed to be replaced.
Follow my steps and raise a complaint with the regulator - they'll eventually rule in your favour!
As a result I am patiently waiting for my fourth / fifth smart meter install but this time it'll be an alt-HAN to fix issues with the IHD display which is over 10 feet from the smart meters
